1. Who we are
ConstructEst Pro (“the Service”) is operated by Tpc Construction inc(“we”, “us”). By creating an account or using the Service, you (“you”, “user”) agree to these Terms.
2. Acceptance
By continuing to access or use the Service you agree to be bound by these Terms. If you are entering into these Terms on behalf of a company, you represent that you have the authority to bind that company. If you do not agree, do not use the Service.
3. The Service
ConstructEst Pro is a web application for U.S. contractors to build itemized estimates, track materials and labor, collect digital signatures, and manage related job data. Access is provided on a subscription basis. Features may change over time as the product evolves.
4. Accounts & accuracy
You must provide accurate information, keep your credentials confidential, and are responsible for all activity under your account. Notify us promptly of any unauthorized use.
5. Acceptable use
You agree not to misuse the Service. In particular, you will not:
- use the Service for unlawful, fraudulent, or deceptive purposes;
- send spam or infringe the intellectual property or privacy rights of others;
- upload malware or attempt to breach, probe, or scrape the Service;
- reverse engineer, resell, or redistribute the Service or its outputs; or
- circumvent technical limits, seat counts, or plan restrictions.
6. Intellectual property
We retain all rights, title, and interest in the Service, including its software, documentation, and branding. Subject to these Terms and your active plan, we grant you a limited, non-exclusive, non-transferable right to use the Service. Content you upload remains yours; you grant us a limited license to host and process it solely to provide the Service.
7. Payments, subscriptions & taxes
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, invoicing, cancellations and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically for the plan's billing period until cancelled. You can cancel any time from the Billing page; access continues through the end of the paid period. See our Refund Policy and Pricing.
8. Availability
We work to keep the Service running reliably, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties of merchantability and fitness for a particular purpose.
9. Suspension & termination
We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination your license ends; we will provide a reasonable window for you to export your data before deletion.
10. Liability
To the fullest extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the fees you paid to us in the twelve months preceding the claim. We are not liable for indirect, consequential, special, incidental or punitive damages, or loss of profits, revenue, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be limited under applicable law.
11. Governing law
These Terms are governed by the laws of the jurisdiction where Tpc Construction inc is registered, without regard to conflict-of-laws principles. Disputes will be resolved in the competent courts of that jurisdiction, unless applicable consumer law requires otherwise.
12. Changes
We may update these Terms from time to time. Material changes will be communicated in the app or by email. Continued use after changes take effect constitutes acceptance.
